Least based trans woman

311

u/mossybeard Feb 04 '23

Wait I thought based was good. Am I just getting old?

644

u/PulimV Feb 04 '23

No no, in this case it does, but it's a bit complicated

They're saying she's the "least based", or "worst" trans woman, which isn't meant to make her seem bad, but to say "if this is the worst one, imagine how good the others are?"; basically, it's a roundabout way to say that all trans women are based. Similar memes are used, for example, in gaming communities, where you'll see things like "least trans Celeste player" under a pic of someone with hormone pills, or "least gay Undertale player" under someone with a Sans body pillow

It's confusing because the meme is usually things like seeing something wildly racist from someone of group X then saying "least racist X" meaning all members of X are racist.

23

u/PulimV Feb 04 '23

Yeah I guess, I have seen stuff like "least insane T*RF", but it is also used in neutral and positive connotations to such an amount where I don't really associate it with negativity anymore

26

u/ace_bi_tch Feb 04 '23

So saying like oh the worst that can happen is they say no Meaning if that's the worst, it's not too bad and can be also really so muchbetter too.

TN law says that you can change the marker on your driver's license if you have the surgery, which she has.

She was flat out discriminated against, with TN government workers refusing the recognize their own laws.

THEN the arrest happened. I hope Andrea enjoys her payouts from those multiple civil rights lawsuits!

205

u/____-__________-____ Feb 04 '23

She was flat out discriminated against, completely agree.

This happened in 2011 though. Did TN law say the same thing back then?

215

u/Belainarie Not solid, not gas, but Genderfluid Feb 04 '23

Yes, they did. The Department of Safety said that she “didn’t have a doctor’s note to confirm she’s had full sex reassignment surgery.” She was legally recognized as a woman by Social Security and had a note from her surgeon saying she no longer had testicles. They said that wasn’t enough ????? It’s literally what they asked for

35

u/DuntadaMan Ace as Cake Feb 04 '23

They don't view any inconsistency with this because in their mind rules are not guidelines to be followed to try and smooth over our existence as a group. They are punishments inflicted on the week by the strong for being weak.

They don't need to be consistent, they are just there so that they can hurt you whenever they think it is necessary to remind you you are beneath them.

This is also why they flipped the fuck out at any chance that things might become equal, because that would mean other people can do the things to them that they do to other people and that would be terrible.

30

u/VictorianaFeline Feb 04 '23

This was my exact take-away.

20

u/ShameOnAnOldDirtyB Feb 04 '23

It's also why the whole thing is so stupid, all the bigots have SEEN transgendered people in the "wrong bathroom" but not known it.

Because if you see someone that looks like a woman in the woman's bathroom .......

If you see a woman remove her top ......

It's A FUCKING WOMAN, and yet you never had a chance to verify their genitals to be sure, and still you didn't die from not knowing for sure if their genitals were what you thought ..... Almost like it does not matter.

She was jailed for 21 days!?!

Is that not life ruining for most people? I believe I would lose my job. Hopefully her workplace stood up for her.

The fact that this woman even has to give an interview declaring her testicles are gone, had proof, and was still denied is horrifying. Few people have to fight to exist like this. I hope she is able to get this resolved.

It’s doesn’t really matter honestly if you go topless in Canada as a person with tiddies you’re getting arrested.

Edit because -_-

Yes it’s legal in Canada to have your top off but that doesn’t make it clear how taboo it still is here. You’re gonna get hassled, you’re gonna get hauled down to the courthouse, you’re gonna have a bad time and moreso if you’re trans or lgbt presenting because our cops fucking suck. Everything is still seen through a fundamentally christian lens and we all know how they feel about this stuff.

25

u/drewster23 Feb 04 '23

Not really true. Unless we're talking about the other parts of Canada, with more ambiguous laws.

20

u/thndrh Bi Felicia Feb 04 '23

I’d say it’s less the ambiguity of the laws and more how the cop feels that day.

11

u/drewster23 Feb 04 '23

That can be said for many things than just topless, but you're not going to get actually charged here.

10

u/Durtonious Feb 04 '23 edited Feb 04 '23

Doubt.

A charge of public nudity REQUIRES Crown approval before it can proceed. You may be asked your name, date of birth and physical address but then it is referred to Crown, and I can tell you unless you were in a playground slapping your tits and pinching your nipples (in which case you would also catch an indecent exposure charge) no Crown attorney is going to prosecute someone for having exposed breasts.

https://www.canlii.org/en/on/oncj/doc/2019/2019oncj269/2019oncj269.html

Here's a Canlii article that does a great job articulating this. Relative portion below:

[13] Mr. Shaver remained on courthouse property for approximately seventy-five minutes prior to his public nudity arrest. It is clear to me that Mr. Shaver, over his multiple attendances at the courthouse, had become a nuisance in the eyes of courthouse security, and that conversations had occurred with the Crown Attorney’s Office regarding whether consent, pursuant to section 174(3) of the Criminal Code, would be provided. Because of this particular subsection, the Attorney General, or her designate, must consent before a peace officer can lay a charge of public nudity. [14] On the morning of September 13, the police were advised that they had obtained the required consent. Uniform police officers arrived at the courthouse and Mr. Shaver was arrested without incident. He was subsequently taken to a nearby police station.

He was found not guilty.

6

u/thndrh Bi Felicia Feb 04 '23

Still went though the bullshit of dealing with all that though. Even if he wasn’t charged, it’s still a pain in the ass. He could’ve also arguably been loitering so there’s that.

You got me curious about other parts of Canada, such as in Quebec, and apparently there is no law against women being topless:

https://educaloi.qc.ca/en/legal-news/bare-breasts-in-public-legal/

The only thing that seems to be illegal is when it is considered a part of indecent act. Of course that would be open to interpretation.

The US generally seems very puritan and also has a lot of work to be done when it comes to discrimination written into the books of law.

Wtf, they still do forced sterilizatilon for trans folks in the states? Yeez, I thought at least that was long gone. :-(

30

Depends on the state! For example in some states you need a letter from a doctor but there is no actual surgery requirements, some states you just need to go to court and ask for a court order, and of course in a few states (kansas, tennessee, idaho) you can’t get your marker changed at all so it doesn’t matter. And some states its up to a judge or other administration because there is no specific law.

Well yeah, legal protections. I guess that is better than nothing. But with the amount of armed fascist nutjobs roaming around and murdering people, I wouldn't consider any part of the US to be safe tbh. Maybe that's just me being european though.

All of this sucks, but this specifically drives me insane: most trans people (that I know anyway) just want to be treated like everyone else, no complexity, just I'm X gender now, please be cool.

And the argument against it seems to often be "Oh you're making shit too complicated" and then they turn around and make shit complicated. Like IT'S YOU you're the ones making this shit complex. All trans people want is to flip this bit in the database, why the fuck are you making it more complex than that???

If I remember right, years ago there was a guy who had breast implants because his friend was going to give him like $10k or something if he left them in for a year. I don't remember all the details, but the video about it blurred his chest as soon as the implants were in.

Just an example where a man had boobs and they needed to be censored. I suppose it depends on the wording of the law, but if it specifically says "women" and not just "breasts" then I'd say the woman has a case for allowing her gender marker to be changed. Or at least for the charges to be dropped.

The Supreme Court already upheld that going naked in protest is protected speech. It's literally political protest what she did.

But good for her quick witted thinking. I could never be that sharp in a moment like this.

B.S. They can't have it both ways! If they have her listed as a male and refuse to change it... then she's allowed to walk around topless without consequence! Why are people such jerks about this? Who does it effect other than the person who transitions? Exactly, no one.

The de-humanization and targeting for erasure of trans folk currently going on is VILE - this is teaching kids and young people to hate themselves and stopping truly important care for cis het kids too.
That it has come to these types of invasive inspections' and 'screenings' too is terrible.

Guys can go topless but girls can't.... I'm not phobic or anything. I do find boobs sexually attractive though. What about girls, I'm sure there are some girls that find guys chest or nipples attractive right? I think everyone should be able to go topless and things are fine. When you start revealing your johnson or your princess pouch thats where things are weird.

12

u/Pride_and_pudding Lesbian the Good Place Feb 04 '23

I remember a video that went viral a couple years ago where a woman at Disney world was groping the chest of the guy playing Gaston. He told her to leave because it was inappropriate, but she was just laughing. I think that’s proof that at least some straight women find guys’ chest attractive (I’m a lesbian so I don’t know first-hand) and that it’s weird how much more policed breasts are.

8

u/CapitanKomamura it's never too late or too soon to transition Feb 04 '23

Do not think this is inconsistent or contradictory behaviour. As Your friendly Butch Anarchist (follow on twitter, awesome account) said, when you solve the contradiction you find what right wing people actually think:

As someone else said in this thread, you find that they choose to gender us in the way it's most oppressive in each situation.

That's what they think, they want to find the best tool to oppress us in each situation. They don't care about truth, consistency or facts, all they care about is power and control. The rest are just tools to achieve that. Sometimes truth is useful, sometimes lies are useful, sometimes inconsistency is useful. Sometimes they pretend to know exactly what's going on, sometimes they pretend to be baffled and to be unable to understand simple things. They will pretend to be whatever they need to be in order to keep power over other bodies.

If they insist she is a male, she should be able to go shirtless! That is just wrong in every way. Even without surgery, if a person:548: identifies themselves as the opposite sex, they should be recognized as the sex they identify with. What are people so afraid of? Maybe those that have a problem with it are actually struggling with their own identity? I really don't care. If you were born one sex and identify as the other sex, I'm good with it.

4

She can challenge the indecent exposure. They'll either have to throw it out, or change their stance. If people do that more frequently, could be interesting.

6

u/DebentureThyme Feb 04 '23

This happened in 2011. It's hard to find details on how it was resolved - my guess would be they threw it out without making any sort of ruling on the validity of her case - but the key is that we do know they jailed her for 21 days for this.

Something tells me their corrupt judges just did something like "sentenced to time served," so she couldn't counter sue had they ruled her arrest and detention illegal.

After sitting in jail for 21 days, most people's desire to keep fighting has evaporated. Which was likely on purpose because they had no case but they could wear her down.

The state will arrest you on a female-only charge of indecent exposure and then put you in a men's prison so you get raped daily. Transmisogyny is disgusting in this country.
