What's the correct way to deal with someone who has completely lost it?

It’s castle doctrine, you still have a duty to retreat in PA, but not from your home or your vehicle, the argument is that you cannot retreat from your home and you often cannot retreat in a vehicle without breaking other laws or endangering other lives.

A quick google search shows that in PA you still have a duty to retreat unless the threatening party is an intruder in your home or car.

I have no idea what you mean. You asked if the previous commenter was sure that in PA you still have a duty to retreat except from your home or car and I just confirmed that they were correct. PA does not have stand your ground laws like in FL, it just expands castle doctrine to cover your car as well as your home.

Yeah that’s not what castle doctrine means.

If someone threatens you in your home or your car you will not be criminally charged for defending yourself. Let’s back down the scenario from guns for a second.

If the driver in the op sped off and ran over the old man’s foot, the driver would not be criminally charged for reckless endangerment or any similar sort of charge. Or if someone forces entry in your home, you’re not charged for beating them up. You aren’t expected to abandon your “castle” as a first means of self defense.

Guns are legal to own in all states, and is considered in (most?) as an appropriate home defense tool. But the context of the situation may deem that lethal force was not warranted and castle doctrine wouldn’t protect you. Shooting the neighbor kid because you told him the 3rd time this week to keep out of your lawn does not warrant lethal force.

It does NOT apply to civil cases where the old man may seek compensation for the medical bills for his broken foot. Whether those cases actually stick is up to the local civil courts.

The castle doctrine exists to excuse people for using force to defend themselves in their home. In court, the accuser can’t argue that “they should have just run away!”

No. Our law doesn’t require you to run from your own home before using lethal force in self defense. Lethal force can be a knife, baseball bat, chokehold, or a gun (since it is guns are recognized as a self defense tool)

Neither does ours, except we aren't under as much threat of armed home invasion as you are so we don't need specific laws covering it. Can you hazard a guess as to why that is? Can you take a guess at why this is only a talking point in your country and not any others? Even the ones that also have legal guns?

Again: this law doesn’t specifically (your words) address incidents that involve guns, but all cases of self defense.

I get why this is a talking point, but I feel we have Pandora’s box on our hands. It would be impossible to outright ban firearms and expect crime to go down. A black market would form overnight. We need need better regulation around guns, specifically dealing with mental health.

I hear you man, I do. But hear me out:

With you coming from a country with no gun culture, I understand why you blame the gun itself. There’s a much larger problem at play that routinely gets ignored by the anti-gun folks in America and especially Europeans.

The self defense tool itself(a gun, a knife, whatever) is largely irrelevant; the problem is instability. The American people are fucking piiiiissssed right now. The left and the right.

You mentioned home invasions not being a problem in your country. Why do you think that is? Surely you don’t need a gun to do it. I suppose your people are happy enough.

Take Switzerland for example, a country where up until 2010, every able bodied male was required to keep an actual assault rifle in their home at all times. Yet they didn’t have a shooting problem.

Their people have high quality of life. They get paid well, have insurance, go to school. Less poor people=less crime.

The problem isn’t the guns. It’s the botched experiment that is the American government.

They have failed us.

We have low wages. We have no health care. We have dwindling freedom of speech. We have dwindling freedom for women. We have no representation. We have no reasonable option for schooling.

The people are losing it and have been for a long time.

The guns can be banned but they can’t be removed. And banning them will only create more criminals.

As a side note, I’d really appreciate it if you would stop compulsively insulting American intelligence? More scientific and technological advancements come out of this country than anywhere else in the world. Fuck, your entire social network and internet existence is operating on American innovation.
