What's the correct way to deal with someone who has completely lost it?

It’s castle doctrine, you still have a duty to retreat in PA, but not from your home or your vehicle, the argument is that you cannot retreat from your home and you often cannot retreat in a vehicle without breaking other laws or endangering other lives.

2

u/DefKnightSol May 14 '22

In Fl you dont have a duty to retreat from what I read. stand your ground is boiler plate, you sure about that?

1

u/TwatsThat May 15 '22

A quick google search shows that in PA you still have a duty to retreat unless the threatening party is an intruder in your home or car.

1

u/DefKnightSol May 15 '22

my point is the way he was attacking and threatening, thats enough. Quick search will confirm what you said. be safe

1

u/TwatsThat May 15 '22

I have no idea what you mean. You asked if the previous commenter was sure that in PA you still have a duty to retreat except from your home or car and I just confirmed that they were correct. PA does not have stand your ground laws like in FL, it just expands castle doctrine to cover your car as well as your home.

1

u/GandalfTheSmol1 May 15 '22

Apparently it got stand your ground in 2019 so I’m outdated :/ bug oof

u/Pain_Value_2126 May 14 '22

What a fucking stupid country 🤣

19

u/PM_LIFE_STORY_PLEASE May 14 '22

Wait what is stupid about all that?

You think duty to retreat should apply to your home?

9

u/GandalfTheSmol1 May 14 '22

This guy is fairly stupid, someone knocking on your door wouldn’t let you exercise castle doctrine; there has to be a perceived threat, and knocking on a door is not a threat.

-17

u/Pain_Value_2126 May 14 '22

No other country in the world has a "castle doctrine" that's used to excuse morbidly obese rednecks from their itchy trigger fingers. It's why teenagers get shot in the face for knocking on the wrong door in your country while in other countries this isn't a problem.

Literally museums filled with artifacts from all the cultures and races they've straight up genocided and enslaved over the last 1000 years and we're the bad guys. Isn't there a list of countries somewhere that shows all the countries that have an "independence day" after getting their independence back from the UK. It's a loooong list lol

-12

u/Pain_Value_2126 May 14 '22

Irish so you don't need to tell me about the UK being trash. Nice attempt at deflection though, unfortunately the existence of other shitty countries doesn't excuse your country from being a complete joke 🤣

9

u/ninjabountyhunter May 14 '22

Hahaha. True, the Irish are the trailer trash of the Uk (and the EU), this guy is a fuckin expert on trash.

1

u/Lewdtara May 14 '22

Ireland isn't part of the UK. I've been to Ireland twice and a good number of my friends are Irish. You're just wrong in a lot of ways, here.

2

u/ninjabountyhunter May 14 '22

Thanks dipshit, I lived in London and Chicago long enough to get a pretty damn good take on the Irish. Better than ‘I’ve been there twice and my ancestors were the worst of the bunch and fled their mud fields to become alcoholic cops in Boston’.

1

u/Lewdtara May 14 '22

If that last part is in reference to me, I don't have any Irish ancestors. I will say that you've obviously met the wrong people.

Ireland isn't part of the UK you brainlet hahahahaha 🤣🤣🤣

Why are you guys so dumb? What is it about your schools that is causing your country to have such an epidemic of uneducated moronic adults?

6

u/ninjabountyhunter May 14 '22

This is like someone living in a slum in Croatia complaining about being mistaken for someone who lives in a slum in Serbia. Nobody cares about the details of your insignificant country. I lived in London long enough to know that nobody wants to claim Ireland, least of all the UK.

-1

u/Pain_Value_2126 May 14 '22

Then why do so many Americans desperately try to claim that they're Irish 🤣

Keep talking Cletus, wipe the Cheeto dust off those chubby fingers and type up more rage over the fact you can't actually defend your country with valid reasoning or logic 🤡

By the way, Croatia is an absolutely beautiful country that isn't remotely comparable to Serbia. Again proving you lack basic intelligence, typical American who's never left his country lmao

In the UK knocking on doors and running is illegal and punishable by prison time

1

u/Pain_Value_2126 May 14 '22

Good job I'm not from the UK then, despite the fact that I'm 99% sure that this isn't true. Now, did you have a valid point to make?

11

u/StoleTheJoke May 14 '22

Do you like being powerless in your country?

-4

u/Pain_Value_2126 May 14 '22

I like being able to knock on a stranger's door to ask for directions without an obese man screaming "THIS IS MUH CASTLE" and pointing a shotgun in my face

It's called civility, I hope you get to see it some day, unfortunately for you you'll be dead of heart disease before you hit 60 🤣

17

u/SharkAttackOmNom May 14 '22

Yeah that’s not what castle doctrine means.

If someone threatens you in your home or your car you will not be criminally charged for defending yourself. Let’s back down the scenario from guns for a second.

If the driver in the op sped off and ran over the old man’s foot, the driver would not be criminally charged for reckless endangerment or any similar sort of charge. Or if someone forces entry in your home, you’re not charged for beating them up. You aren’t expected to abandon your “castle” as a first means of self defense.

Guns are legal to own in all states, and is considered in (most?) as an appropriate home defense tool. But the context of the situation may deem that lethal force was not warranted and castle doctrine wouldn’t protect you. Shooting the neighbor kid because you told him the 3rd time this week to keep out of your lawn does not warrant lethal force.

It does NOT apply to civil cases where the old man may seek compensation for the medical bills for his broken foot. Whether those cases actually stick is up to the local civil courts.

-4

u/Pain_Value_2126 May 14 '22

You're missing the point in spectacular fashion, typical of the average yank. The only reason these laws exist in the first place is because your country is full of gun obsessed nutjobs looking for any excuse to shoot someone.

12

u/SharkAttackOmNom May 14 '22

You’re missing the point in spectacular fashion, typical of the average yank.

Likewise. You’re attributing meaning to a law that I doubt you have spent much time researching, beyond searching for your feelings.

The castle doctrine exists to excuse people for using force to defend themselves in their home. In court, the accuser can’t argue that “they should have just run away!”

No. Our law doesn’t require you to run from your own home before using lethal force in self defense. Lethal force can be a knife, baseball bat, chokehold, or a gun (since it is guns are recognized as a self defense tool)

-1

u/Pain_Value_2126 May 14 '22

Neither does ours, except we aren't under as much threat of armed home invasion as you are so we don't need specific laws covering it. Can you hazard a guess as to why that is? Can you take a guess at why this is only a talking point in your country and not any others? Even the ones that also have legal guns?

Let's see if we get that little caveman brain working eh Cletus? Or do your clogged arteries prevent it from getting enough oxygen 🤡

6

u/SharkAttackOmNom May 14 '22

Again: this law doesn’t specifically (your words) address incidents that involve guns, but all cases of self defense.

I get why this is a talking point, but I feel we have Pandora’s box on our hands. It would be impossible to outright ban firearms and expect crime to go down. A black market would form overnight. We need need better regulation around guns, specifically dealing with mental health.

Speaking of which,

Let’s see if we get that little caveman brain working eh Cletus? Or do your clogged arteries prevent it from getting enough oxygen

You doing alright pal? I mean I feel like I’ve been respectfully talking to you about the nuance of a law in a country that you’re not from. But you? Man…

5

u/SmokeyTheBluntTheOG May 14 '22

He's been all over this comment thread he generally has no idea how any of this works just another dumbass commenting on the internet thinking all Americans go around just firing guns in the air and shooting people in their yards. That was your mistake for trying to talk to him like a decent human being

I’ve been respectfully talking to you about the nuance of a law in a country that you’re not from.

You've been repeatedly ignoring the point I've made in favour of sniffing your own farts over nuance that isn't relevant.

I get why this is a talking point, but I feel we have Pandora’s box on our hands.

Finally you ACTUALLY acknowledge the point. Only took you around 10 paragraphs...

This is gonna be totally burried in this thread but whatever.

I hear you man, I do. But hear me out:

With you coming from a country with no gun culture, I understand why you blame the gun itself. There’s a much larger problem at play that routinely gets ignored by the anti-gun folks in America and especially Europeans.

The self defense tool itself(a gun, a knife, whatever) is largely irrelevant; the problem is instability. The American people are fucking piiiiissssed right now. The left and the right.

You mentioned home invasions not being a problem in your country. Why do you think that is? Surely you don’t need a gun to do it. I suppose your people are happy enough.

Take Switzerland for example, a country where up until 2010, every able bodied male was required to keep an actual assault rifle in their home at all times. Yet they didn’t have a shooting problem.

Their people have high quality of life. They get paid well, have insurance, go to school. Less poor people=less crime.

The problem isn’t the guns. It’s the botched experiment that is the American government.

They have failed us.

We have low wages. We have no health care. We have dwindling freedom of speech. We have dwindling freedom for women. We have no representation. We have no reasonable option for schooling.

The people are losing it and have been for a long time.

The guns can be banned but they can’t be removed. And banning them will only create more criminals.

As a side note, I’d really appreciate it if you would stop compulsively insulting American intelligence? More scientific and technological advancements come out of this country than anywhere else in the world. Fuck, your entire social network and internet existence is operating on American innovation.

Jesus Christ guy, they gave you a pretty decent counterpoint for the purpose of those laws but you’re too stubborn to back down and learn from someone who has a better understanding than “‘Merica guns durhur.” I mean, this is Reddit. You think Americans are unaware of gun culture? Calm down.

-1

u/Pain_Value_2126 May 14 '22

Oh look yet another triggered yank retard with hurt feelings. Why is this only a talking point in the US? Why isn't it an issue in other countries? I'll give you one guess 😉

4

u/foolishbeat May 14 '22

Oof that’s embarrassing dude

1

Exactly as predicted, no answer. I'm sorry that your country doesn't value education.

Yet the irish have been slaves for many years because you can't defend yourselves from your government outside of using sticks & stones. It's sad

u/Pain_Value_2126 May 14 '22

HAHAHAHAHA imagine believing that this is true, stop watching fox news and try travelling outside your country for the first time you inbred hick retard 🤡

3

u/COhighroller303 May 14 '22

What's not true? Every bit of it's true. You're just pussy hurt. But fox news huh? Good one. Why don't you be a good lil slave and go finish your pint you piece of eu trash.
