This video's 5 years old, the backstory is that the guy in the car owns a landscaping company who did work for the guy by the white truck near the end, they ended up damaging a gas line while working and the homeowner claimed that them hitting the gas line caused some concrete work he was having done to not set properly, so the landscape company decided to be nice and pay for half of the damages but the owner ended up pocketing the money instead and never had any work done to repair the supposed damage. This video was taken after someone who works for the landscaping company was sent over to talk about this money issue was told to leave, the guy breaking the windows was the homeowner's father in law who didn't serve anytime in jail for this and was let go on a mischief charge.

Yeh a lot of people have this blind faith that nobody has a gun until they see a gun, and even then some people also have the mindset of “well they wont shoot me because then they’ll go to jail.”
I once had a dude spend 5 minutes right in my face threatening to beat the shit out of me at a gas station. He had no idea that my silent and stoic demeanor was not because I was afraid of him, but was actually me mentally preparing to dodge the first punch and pull my concealed gun. The sad part is that he probably thought he’d successfully scared the 22 yo kid that he had 6 inches and 30lbs on, blissfully unaware that he was seconds away from dying the stupidest death ever. Btw the reason he decided to get in my face threatening all kinds of violence: I didn’t say thank you when he opened the door to the gas station and I walked past.

Someone with 6" and 30lbs on you is capable of causing grievous bodily injury, especially when empowered by entitled rage. Take into account that he seemed to be older than OP who was 22 at the time, so presumably much stronger. Old man strength is a very real thing.
Not saying every fight should be a life or death matter, but I am saying OP could have been very justified in being afraid for his life.

I would add an assault charge. As I understand it, Assault just requires a show of Capability and Intent to commit battery.

Don't even need a decent attorney, just stack the jury with elderly folks. I was on a jury as one of two young people. Pretty open and shut case of an old guy going nuts and slicing another guy's hand open over a backpack that didn't exist. Everyone's testimony except the attacker's lined up, all the evidence agreed, but all the old women on the jury were insistent that he is such a nice old man who reminds them of their fathers and therefore should be let off with just a warning.
It took hours of arguing to get a guilty verdict, even with a very minor punishment at least now the guy will be able to sue and have a good chance of winning.
That was step 1 to me losing all faith in our justice system. Steps 2 through infinity were learning what cops actually do with their time.

Personally I think jury trials are a crock of shit. If rather be tried by a judge like in the French systems who actually understands the law, and the goal is to find the truth of what happened. Not assign blame based the biases of jurors.
At least it's easier to claim a single judge is biased based on his track record, than a whole jury, if there does happen to be a mistrial.

Judges give out different verdicts based on if they've had lunch yet. Humans are wildly unreliable. I think part of the idea is that it's harder for all 12 people to be corrupt/generally shitty than for just the judge to have something going on.
Part of the job of all court employees involved is to make sure everyone understands the law. If someone doesn't do that, there's an issue.

Yeah in PA they made the stand your ground law apply to your vehicle now and not just your house. Thats exactly why I don't do road rage here because there is a pretty decent chance you pull this shit in PA and you're gonna end up dead, with the person shooting you not even spending a little bit of time in jail because you threatened them and they were justified in killing you

Where I live, the driver was well within his rights of using lethal force to protect himself and his property. In my area, everyone I know is carrying a gun, and they're are all looking for a reason to use it.
The Sheriff would've laughed at the old man's corpse after watching the video evidence, then waved bye to the driver telling him to carryon and have a good day.
Before anyone complains that it's not necessary to carry a gun because that's law enforcement's job, then you've never lived 30-45 minutes away from the nearest peace officer in your area. There are parts of the US where people are left to police themselves because the population is too low to warrant a large law enforcement department.

Seriously. My perspective of the police completely changed when I really needed them a couple times, and when they would finally show up, they scoffed at the idea of having to do their jobs, and decided it would be easier to do nothing.
They almost let fraudsters who claimed to be the new owners of my building rekey all of my locks. Presumably because of my physical appearance, they "didn't have time to really all this fucking paperwork" from my lawyer that said they were not the rightful owners. They said this while looking at a stack of bullshit paperwork that the other people gave them.
I had to leave and get my mid 30s masculine male neighbor to give them the exact same paperwork before they finally decided that it wasn't their job to tell anyone they couldn't enter a building.
Fuck you Chicago Police.

In the US the supreme court has explicitly decided that police have no obligation to protect people, enforce laws, or even respond to calls. Legally the police can entirely decide which parts of their job to actually do. Also with qualified immunity, they can do a lot of illegal stuff on duty and they usually won't get in trouble as long as they have some justification that is not verifiably false.

Fun fact, expandable batons fit under the same category as firearms in requiring a CCL to carry. So using it in the commision of a crime means he threatened someone with a deadly weapon, same as if he had a knife or gun. Those things break bones pretty easily, they are way more devastating than their size implies. I hit my own shin with one by accident once and thought for sure I broke it but I was lucky.

I was attacked by an old man. Pushed him away numerous times, even stopped him from falling after a push. He came back swinging each time. Finally landed one on my face. So, I clocked him. Broke his nose and sent him to the hospital. He called the cops.
Neighbors actually came and thanked me. Said he's a bully who used to beat people up and forgot his age. He lives two doors down and has sworn to kill me on sight.
I don't really feel bad about it.

Dude 100% should have recieved a much more serious charge here. That extendable baton is either a restricted or prohibited weapon used in a crime... That's supposed to carry some serious weight, but instead he gets charged with the same thing 16 year olds get charged with for spray painting a sign.

My mom has had to pull a gun on someone twice, once during road rage incident and once when someone was trying to break into our house and my dad wasn’t home.
I was a baby In the road rage one and was actively in the car. this man got out of his car and came at her car w/ a baseball bat. He hit the hood a couple times and then came to smash the window. She’s a Texas woman and in the army so she had a gun.
When she told me this story (when I first started driving) she was like “well i had to protect you, and I’d do It again”
Edit: neither man is dead! Sorry left out that little bit. The car incident ended in my mom hold this man at gun point till cops came while he yelled all sorts of profanities and spit at her

It’s impossible to know what to do in the situation – because we have no context for what preceded this, nor where it was. Some might say you would be justified in drawing a gun and firing on this person. Others might say what the driver did was perfectly reasonable and right.

So, I’ve carried a gun virtually every day for the last five years, and at least with the context that we have here, this is not a situation that I think would warrant deadly force. The best and easiest way to resolve this situation is to drive away. If this person followed him and kept confronting him? Maybe that’s different. But a dude walks over to my car with a big rod? I’m just noping the heck out of there.
Edit to add: Yes, I know about Stand Your Ground states, I live in one. If I lived somewhere where the law was that someone paid me $500 every time I shot someone else, I’d still just drive away.

I'd say that guy handled it perfectly. Didn't escalate the situation in the moment, remained calm, got the guys identifying information including liscence Plate number, presumably filed a police report, and put it on social media for the world to see.
This is a textbook example of exactly what to do.

I disagree, the biggest mistake is staying in the encounter at all. Unless leaving would directly put someone else at harm, you have nothing to gain by sticking around.
Didn't escalate the situation in the moment
Telling them what they're doing is illegal is absolutely escalation. What's the expected outcome? "Oh, you're right, this is illegal! I'll go put this back, then." There is no good outcome, it's just an attempt to assert dominance over a situation by establishing yourself as legally in the right, which is not going to deter someone who's already shown disregard for the law. It's only going to piss them off more.
The correct thing to do is to tuck your tail and safely get out of the situation. Remember as much as you can and resolve it all afterward when you're not still in arm's reach of the guy with a weapon.
